Drug Driving

Defending Drug Driving Charges in NSW

When it comes to driving and drugs, it is recognised that drugs can stay in your system after the immediate affects have worn off. That’s why there are 2 different types of driving and drug offences:

1. Driving with illicit drugs present

This is a less serious offence but can still incur harsh penalties. You will receive this charge if your drug driving test indicates there are drugs in your system but you appear alert and calm. In this situation, the police cannot assert that you are still under the influence of any drugs. However, they can suspend your driver licence and issue a Court attendance notice.

2. Driving under the influence of a drug

This is considered a more serious offence because you are potentially causing harm to the wider community. In this situation, not only will the police conduct a drug test, they will also look for signs that you are high. These include:

  • Glazed eyes
  • Slurred words
  • Agitated or argumentative behaviour
  • Shaking or perfuse sweating

As it is considered a more serious offence, you can incur much higher fines and longer licence suspensions. Depending on your circumstances, you could also be imprisoned.
