Demerit Point Licence Suspension
What are your options?

Have you got a fine that will push you over the demerit point limit? Or, have you received letter from the RMS indicating your licence will be suspending for a period of time?
It is important to remember that you have options!
- Take the Penalty Notice to Court;
This is only available if you have received a penalty notice that will result in you accruing too many demerit points. For example, you may have received a penalty notice for using a mobile phone while driving, and you already have 10 points accrued. This would take you to 15, which means your licence would be suspended.
You can elect to have this penalty notice determined by a Court. This is often the best option when you have a strong subjective case and the offence is quite trivial. To succeed, you would need to have the matter dismissed. This is known as a ‘section 10’ and means that you do not need to pay the fine and the demerit points are not attached to your licence.
If your traffic record is not particularly good, or if you have committed this offence numerous times previously, this option may not be the best one for yourself.
- Good Behaviour Licence
Another option is to pay the fine, and then opt to take a good behaviour licence. This means you would only have 1 demerit point for a period of 12 months.
This is a good option if you are certain that you can go for 12 months without committing any further offences.
If you choose this option, and then commit another offence, you would need to serve double the original suspension period.
- Accept the RMS Suspension
This is a very unattractive option to many people!
